Terms of Service

1. Service Description

AECKraft ("Platform") is a cloud-based project management, customer relationship management (CRM), 3D visualization, and team collaboration platform for firms in the architecture, engineering, and construction (AEC) industry.

The Platform is provided through a web browser using the SaaS (Software as a Service) model. Users gain access to the platform by creating a membership and use the features within their selected plan.

AECKraft may add new features, modify existing features, or discontinue features as part of continuous platform development. Significant changes will be communicated to users in advance.

2. User Obligations

Platform users agree to the following obligations:

• Providing accurate and up-to-date information during registration
• Maintaining the confidentiality of account information and not sharing it with third parties
• Using the platform only for legal purposes and in accordance with these terms
• Not attempting to compromise the security of the platform
• Not abusing the platform, uploading spam or malicious content
• Respecting the rights of other users
• Ensuring uploaded content complies with copyright and legal regulations
• Being responsible for all activities on their account

3. Intellectual Property Rights

All software, designs, text, graphics, logos, icons, and other content on the Platform belong to AECKraft and are protected under Turkish Intellectual Property Law and international copyright legislation.

Users retain ownership rights over data they upload to the platform (project files, customer information, documents, etc.). AECKraft processes this data solely for the purpose of service delivery.

AECKraft may use content uploaded by users for anonymous and aggregate statistical analysis. Individual data is not shared with third parties.

4. Service Level Commitment

AECKraft targets a minimum of 99.5% annual platform availability. Scheduled maintenance is excluded from this calculation and will be communicated to users in advance.

• Scheduled maintenance: Notified at least 48 hours in advance and performed during low-usage hours when possible
• Emergency maintenance: May be performed without prior notice for security vulnerabilities or critical bugs
• Data backup: User data is backed up daily

AECKraft cannot be held responsible for service interruptions caused by force majeure events (natural disasters, cyber attacks, infrastructure provider outages, etc.).

5. Pricing and Payment

AECKraft offers free (Starter) and paid (Pro, Premium) plans. Current plan details and pricing are available on the pricing page.

• Paid plans are billed monthly or annually
• Discounts are applied for annual plans
• Price changes are communicated at least 30 days in advance
• Fees already paid for the current period are not affected by changes
• All prices are stated excluding VAT; VAT is added separately on the invoice
• Account access may be restricted in case of payment delays

6. Termination Conditions

Termination by User

• Free plan users can delete their accounts at any time
• Paid plan users continue to benefit from the service until the end of the period; no renewal after cancellation
• Data is permanently deleted within 30 days upon account deletion request
• Data export option is provided before deletion

Termination by AECKraft

• Accounts may be suspended or closed in case of terms of use violations
• Accounts are immediately closed upon detection of illegal activities
• Account access may be restricted for prolonged non-payment
• Users are notified before account closure decisions (except in emergencies)

7. Limitation of Liability

AECKraft declares that the platform is provided "as is" and "as available." Liability for direct or indirect damages arising from platform use is limited to the total service fee paid by the user in the last 12 months.

AECKraft cannot be held liable for:

• Results arising from incorrect data entry by the user
• Outages of third-party service providers
• Service interruptions caused by force majeure
• Damages arising from the user's failure to protect account credentials
• Business losses or profit losses resulting from decisions made on the platform

8. Dispute Resolution

These terms of use are governed by the laws of the Republic of Turkey. In case of disputes between the parties, amicable resolution methods will be sought first.

If a resolution cannot be reached, Istanbul Courts and Enforcement Offices shall have jurisdiction.

9. Right to Modify

AECKraft reserves the right to update these terms of use at any time. Significant changes will be announced to users via email and/or in-platform notification at least 30 days before taking effect.

Continuing to use the platform after changes take effect means you accept the updated terms. If you do not accept the changes, you have the right to close your account.
